Section 504

 

The Clayton County Public Schools (CCPS) ensures that individuals with disabilities are not discriminated against as a result of a disability. The district abides by the requirements of Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act (ADA) of 1990 as well as the revisions in the Americans with Disabilities Act Amendments of 2008 (Amendments Act) effective January 1, 2009. The Amendments Act revised the Americans with Disabilities Act of 1990 (ADA) and included conforming amendments to the Rehabilitation Act of 1973 that impacts the meaning of disability in Section 504

 

Section 504 states: 

 

No otherwise qualified individual with a disability shall solely by reason of her or his disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance. 


In compliance with Section 504 and ADA, Clayton County Public Schools agrees to provide students covered under these acts with a free appropriate public education. Under 504 and ADA, a person is considered to have a disability if that person (29 U.S.C. Sec. 706(8)): 



1.) has a physical or mental impairment which substantially limits one or more of such person's major life activities, 
2.) has a record of such an impairment, or 
3.) is regarded as having such an impairment.

504 Child Find Statement

Pursuant to Section 504 of the Rehabilitation Act of 1973, the District has a duty to identify, refer, evaluate and if eligible, provide a free and appropriate public education to disabled students.
